DBMS congratulates Karen DeGrand and Laura Ieremia for their successful attack on a 2021 amendment to the Illinois interest statute, 735 ILCS 5/2-1303. The amendment imposed a prejudgment interest obligation on defendants in lawsuits alleging personal injury or wrongful death. In the fall of 2021, the DBMS team joined the briefing and argument in a medical malpractice case in which the defendants challenged the constitutionality of the statute, for, among other reasons, unfairly burdening healthcare providers among other individuals and entities throughout the state. Holding that the statute impermissibly impacts the fundamental right of Illinois defendants to a jury trial and constitutes special legislation irrationally benefiting only one category of plaintiffs, the Circuit Court of Cook County struck down the statute on May 27, 2022.
