DBS Obtains a Defense Verdict in Cook County

Tim Hogan and Katie Trucco successfully defended an anesthesiologist and certified registered nurse anesthetist (CRNA) in a medical negligence trial in Cook County. Plaintiff underwent a total knee replacement surgery on June 1, 2017, and alleged that pre-operatively, the defendant anesthesiologist negligently failed to prepare an anesthetic plan that appropriately considered his underlying glaucoma, and that the CRNA failed to communicate intraoperative blood pressure fluctuations to the anesthesiologist. Plaintiff alleged that intraoperative blood pressure fluctuations caused ischemic injury to his optic nerve, resulting in vision loss to his left eye. The defendants presented evidence that the anesthetic plan was appropriate taking all of the plaintiff’s comorbidities into consideration, including glaucoma, and the anesthesia record showed no evidence of sustained hypotension or hypoxia to cause ischemic injury to any organ, including the left eye. The defendants argued that the plaintiff’s vision loss was more likely caused by idiopathic ischemic optic neuropathy instead of perioperative optic nerve injury. The jury deliberated for an hour before returning a verdict for the defense.
